All the best asdcrajnet.. Both countries are equally good, we have lived in both.. so we know how to adjust..
Few points that you may need to find out before you go..
1) Apply for POI for your kid, you may have already done it. There is a restriction that you need to visit nearby police station every 180 days if your son is in India (because he is a US citizen), try to find out more about that and see what you can do to avoid it (may be get a India visa as opposed to a POI)
If you go to a police station, 100% guarantee they will ask for a bribe or make things difficult for us.
2) The school fees for non-Indian citizens is very high, because your son falls under NRI category, try to find out about it, and if possible share with us too.
Everything is good back home but there are few issues which I see are a problem,
1) Nothing moves ahead without bribery, if we need our stuff to move up the queue, say if it is land registration or getting approval for something - it will not move with bribery and any govt office related work we need to wait a lot and service is bad, unlike here in US there is no bribing and things are so streamlined and good. We can talk about ethics and moral values and not give bribe but then our need will never get fulfilled for years if we decide to go as per queue.
2) If you are in IT, the work hours are horrible, most of IT companies are outside city limits, we will end up going early in the morning and return late night (because hey we need to talk to onsite guys). If an employee leaves at 5:30 or 6 PM it means there he is not working - not sure when this culture would change there. Again most of them work on saturdays, so only sunday is a holiday, here in US i can leave work at 5 PM or 5:30 and come home and spend time with family.
3) Commute is very tough back home - too much traffic than what the roads can handle, there is traffic in US too but it is decent traffic, everyone follows rules and lane sense is there. Back home it is really horrible.
For your PD you have waited for a long time, I would suggest you wait for 1-2 more years and give it a try. We can always go back to India no one is going to stop us, but the return is not very easy. Nowadays h1b approvals and stamping has become a nightmare.

My son Has the PIO card. The rule is we have to register with "Foreigner Registration Office" if he stays for more than 6 months. So I got to do that only once. I think there is some procedure when he turns 18. My son will be studying in a Private school. The fees are the same.
We got to be a Roman in Rome. If we have to bribe a little to get things done, I will do it. I am not there to change India. But I would really try to implement something what I learnt in US. I would never throw garbage in the streets(Preach others not to do it). Be kind to all people.

In India it is only reserved for the rich. Other than that both are fine with me. One big advantage in India is the extended family. I love lot of people.

Been in the US since 1998, have an EB-2 PD of 2001, have played by the rules all along. Still no GC... And, the dates are going back to 2000 from the new year.. I've lost hopes...
I'm pretty close to getting clinical depression because of this game played by USCIS, Labor Dept, FBI and my own bad luck.
SKILL bill, OMNIBUS, etc. comes and goes. IV does seem to be doing things to lobby for the community, but let's face one reality. Like a news article said, no one in congress or senate wants to touch immigration even with a long pole until 2009.
The US has been very good to me (other than the GC part), more than my home country (India) which is why I'm still here.

I called them and reached an IO officer and told her that I see my checks are cashed and there is a receipt number behind the check but its illegible and can she confirm the numbers for me. She asked for DOB, address, full name etc. and then gave me the receipt numbers for EAD, AP and AOS.
But if your checks are cashed then the receipt notice must be in the mail.:)

This thread is specifically discussing the Cornyn bill. I will not put down a lot of irrelevent stuff, but let me say this and end.
The tone of ur earlier posting may have hurt some people.
Some of the reforms that happened and some the IV is pursuing will probably help most H4's a long way.
Earlier (even now for those stuck in PBEC) the labor used to take 2-3 years. With PERM most of the labors r taking 4-6 months. I140 also seems to be very fast.
Now if every body is able to adjust their status upon labor approval, that is less than a year's wait time for H4. Not a bad deal.

I mailed mine on May 25 and up to now I haven't gotten anything yet. My lawyer mailed it to NSC and since my I-140 is pending with the TSC, my lawyer said they will just forward it there. It's taking too long. Anybody in the same boat as I am?

On the one side you have the EB2. Earning more, and better educated. Clearly more important human beings to IRS and society. On the other we have EB3 Junta trying to get what they think is their right to spillover.
Now I understand all your points and agree with all of them.
Only 1 question :D why is IV not fighting to increase the regular (non spillover) quota for the clearly better category EB2. This is clearly not fair such super humans having to share same numbers as lower categories. Lower categories should go to Bombay where there is one apartment which is still empty.
Or better still get rid of the EB3 category altogether. Problem is solved! :D

Hi Guys,
I came to know that if there is a significant increase in the new salary compared to old labor salary, the chances of getting a query is more.
Let us assume that if you old labor salary is X and if you want to take up a new job with X + 30% or more the chances for USCIS query is more.
If the salary increases between the jobs is 10% there should not be any issue.
Of course, these words are not from an attorney, i talked to a senior guy who is in this profession.
Before you are planning to use AC 21, please consult with attroney first and they only accept the new job.

FYI...
My friend and his wife received Receipt Notices for 485, EAD and AP on August 10, 2007. The Received Date (when application reached NSC) was June 25, 2007. And yesterday (August 13, 2007), his wife's EAD was approved. They still haven't gotten their FP notices as yet.
BTW, their packet was transferred from NSC to TSC since the I-140 was approved from TSC. It appears TSC is faster in processing EADs/APs than NSC.
Other details: I-140 was PP-approved from TSC in June 2007 and the application is EB2.

Package received by Nebraska SC: June/4.
Check cashed: June/14 (it shows LIN# on the back).
Querying status using this number shows a receipt date of June/12!
Samething happened to me. TSC received my application on June 6th, but when I checked my status it says that they received my application on June 11th.
