If there's a recession (even with a soft landing) in 2007, as many economists and Wall Street people are saying, and we don't get SKIL Act through congress during lame-duck session -- what will it mean for us? Will business lobbies still have a strong case to sell to lawmakers amid a recession?..
Yes I think you brought up a very good point. Not sure how much the recession/soft landing will affect the high technology job market. The high tech job market is just picking up in many areas and companies are having tough time to get employees. Whatever the opponents of H1B might say, the fact is getting eligible candidates is tough in many areas. And that is why many big companies are advocating visa increases (they have vested interest in only asking for h1b increase and dont care about EB numbers; thats a different issue). To take advantage of that sentiment this is the best time. We dont know how political/economic situation in next year (2007) and 2008 being presidential election year, immigration can become a hot button issue and politicians will club our issues with illegals which can confuse everyone. Lame-duck session is our best chance yet to have any of our measures. Corporate world looking for more H1B numbers will work hard and try to put in their measures in some bill. We have to work hard to have our measure clubbed to them.
If SKILL bill is passed in total that would be our best case scenario but I think its really difficult (anti-immigration groups and their lobbying is much stronger than many of us think; just look at what happened in the last one year to several bills that are even slightly favorable to legal immigration).

It would be great if DC area news agencies are given a headsup about this act of gratitude toward Emilio... It would be nice if we can get actual reaction from Emilio.. he'l probably think he's been punk'd..

Among the very wonderful suggestions that many have given, I can tell you from my own experience, being a trained teacher of doing breathing exercises leading to meditation every day for the past 9 years, the whole perception and observation of our mind drastically changes! Not only that, the changes in our consciousness are so deep, the effect is profound and permanent. This comes from my own experential level as well as those I teach.
It is very difficult to train our mind thro' our mind and hence the breath which is the connection between the inner and outer world comes into the picture. Thro' our breath we can relax this mind to levels much deeper than sleep. The result of soaking our minds into this relaxation changes our whole perception, observation and expression and that too effortlessly !!
Seldom do we dive deep into the depths of our being. There is a great science behind our thought patterns and depression and why and when we get them and the method to unbound ourselves from these patterns.
"There is an art to gain the ability in life-it's very simple, just a skill-the ability to free your mind of the past, to free your mind of the future fears, and to be able to play with every situation that is in front of you."
- Sri Sri Ravi Shankar

Thanks gc28262 for your contributions to this drive. I request others to pitch in as well. We can discuss the nitty-gritties till we bleed. But that won't achieve anything. It will not stop the minformation being spread. We have to collect enough evidence and present it to the media. 4-5 job ads is just the beginning, we need a collection of few hundred to prove this is the prevalent trend.

I see that the minimum contribution to IV is $50. Any chance that IV will make it $20 and see how many new contributions it will get to see?

Earlier only two of my I-485 checks were cashed, now all my checks (EAD, FP, AP, I-485) for my dependants and me got cashed.
Will keep you guys updated on the progress.
Since these cases are seeing daylight, I have question about FP. Anyone who has got FP (only for cases if RN received after 9th oct )?
I am planning to travel in November hence worried. If you know approx FP dates please let me know.

So, we're back to the semantics. We need USCIS/DOL definitions of "permanent" and "legitimate"--not the definition just for educators/tenured teaching positions, as desi3933 gave. If we don't have the definitions, we can/can't assume anything/everything. Therefore, self-employment in same/similar occupation, with a *projected* cash flow, should be classified as "FT, permanent."
You are wrong, again!. ;)
I said this before, Permanent job does not mean "forever", it simple means it has no fixed end date (i.e. indefinite duration). That said, most of the Permanent Jobs are, in fact, at will jobs.

I am going to complete my 180 days by 1st week of Decemeber. The company I work for, is offering me a Project Manager position. My labor is filed for a programmer. I asked my lawyer and he told me that they sent a email to Florida State Workforce Agency to classify my new position and depending on the reply he tells me that I may or maynot port my labor.
Is anyone in the same boat? Is there any work around? I have been on H1 for 10 years now working for the same company (2 yrs as Contractor and 8 as employee), they have screwed me many times, I just don't want another disappointment. If this does not work, then I guess I have switch another company....

It high time that these guys get kicked on what ever, I have seen so many of my friends frustated due to non payment and get scarred to do anything against it..... I appreciate your courage , If they do bussiness and employ people they should legally pay, So many poeple come from India with kids and family and suffer so much when they are not getting paid on bench...I can only sympathise with their situation , Shame on such bussiness...BLOOD SUCKERS, MANIACS . I would say USCIS should create a law to punish these blood sucking monsters.

Shouldn't IV ammend the text of the email to better reflect the negative impact of the Bernie Sander's ammendment ? The Senators (who are known for not often reading voluminous legislation in detail) may have voted with their hearts for this ammendment thinking this was going to help students in their states. I think IV members who are their constituents should have a means of letting their Senators know the effect of their actions and for those who voted against it they should be congratulated for voting against this harmful ammendment. They may have thought of this as win-win situation. Yet they may have not known the following points (read the study its detailed):
http://www.nfap.com/pdf/0507brief-business-immigration.pdf
U.S. businesses pay over $91 billion a year in state and local taxes directed toward public education, while the mandated scholarship and training fees U.S. companies pay for each H-1B professional hired are approaching $2 billion since 1999, according to this National Foundation for American Policy analysis. These findings undermine the argument that companies should not be permitted to hire international students and other foreign nationals on skilled visas unless they do more to support U.S. education.
For example Bernie Sanders spent his time barraging Microsoft and used quotations from Microsoft executives to argue for the $5000 fee for H1-B filings. Had other Senators been educated on how the H1-B program has benefitted the US economy they would have reconsidered their positions :
The figures presented in this analysis show the argument against H-1B visas further falls apart when examining the already substantial taxes, fees, and charitable contributions made by U.S. companies. The Gates Foundation alone, funded by Microsoft stock, has contributed $3 billion to U.S. public education since 1999.
Record of Senators who voted for or against the ammendment (http://www.senate.gov/legislative/LIS/roll_call_lists/roll_call_vote_cfm.cfm?congress=110&session=1&vote=00179)

For god's sake, if you intend to send hundreds of emails and letters and call yourselves highly skilled immigrants, can you take the time to have your letter proof read by someone? If not anyone, at least by Microsoft Word?? I start reading the text of some of the emails and shake my head at some of the gobbledegook you are spewing. It is counter productive to say the least.

I filed I-485, I-131, I-765 for myself, my spouse and my 10 year old daughter. The papers were received at NSC on 30th July, 07. Three days back we received all the receipt notices with receipt date shown as Aug 1 and notice date shown as sept. 10. All fine so far.
I then went to USCIS site to check on-line status, but here was the surprise. It gave the correct status of all the receipt notices, except that of I-485 and I-131 for my daughter. When I key in her receipt nos., I get the message that these nos. don't exist and I should enter the correct no.
Now what is that? How come my and my spouse's record is entered but not of our daughter's inspite of the fact that we have her receipt notices with a proper receipt no.
Can someone suggest what could be the reason and what course of action I need to take so that the situation is corrected. Help please

So you basically want a piece of the discussion no matter you are involved in it or not. The OP asked for advice/opinion, and I had the right to respond because it is asked. Whereas you chose not to give your opinion, but just decided you wanted a beef with me, which proves that you have too much time on your hands for things that is not asked of you.
After page 2, I went after only those who attacked me for being who I am, that is trying to be morally right. And today I went after gvenkat who wanted me to "grow brains", and also asked me if I think the OP should go back home, to which I provided my answer.
So unless you were totally jobless, you had no business commenting. You only want to be a part of this discussion because somewhere inside you there is a conscience that is very guilty for not being what a person really should be. And what better way to kill that feeling than to shoot down anyone else that wants to hold people responsible morally.
I understand where you're coming from. And the fact that you are still coming after me proves to me even more how your conscience is eating you from the inside.
You have reading comprehension issues as well...if you get over yourself then you can comprehend things (let me be clear, I am referring here to my own posts and none of the other ones). You made your point on page 2 about the moral/ethical/legal perils of what the OP has done/proposing to do. You were fine with me. Continuously pointing out at other people as to how morally bankrupt they are (including your latest post) or how bad there comm skills are (written or otherwise) will certainly expose you to shots from others (like me). When you continuously point out others' morals then the presumption here is that you are squeaky clean. I pointed out, you are not. That is all. It does not mean, OPs post is morally/ethically/legally on the right side or I hold that opinion (actually I do not).
