    i see an LUD change for my case today with my I140 pending at TSC sent my 485 to NSC July 2 9:55 AM Fedex , LUD change date is 8/12/2007 , does it make any sense or what indication it is ?

    These guys are not consistent. I should have gotten a 2 year EAD.

    Dunno who to take this up with.

    Sorry to hear they gave you 1 yr EAD.

    I don't know why USCIS just don't make their ( and our) life simpler by just issuing 2yr EADs. Deciding how close to current is close enough for 1 yr EAD is extra effort. If its a funding issue, they can give the customer the option for multi-year EAD and extra fee.

    Hi

    Both and spouse and I received my receipts for our I-485, I-140, EAD, AP 09/19/07. On 09/24/07 we received fingerprint notice and on 09/27/07 we received our EAD card. I am quite surprise by how fast it came. Here are my details :

    Priority Date: 10/15/04
    Type: EB3
    I-140/I-485: Concurrently filing at NSC. Receipt date 07/07/07
    Checks cashed: 09/10/07
    Receipts received: 09/19/07
    Fingerprint appt: 10/09/07

    During your conversation with mirage, did you explain to him why it would hurt our cause ? From our discussion in the group, it didn't seem he was aware why IV core was against it.

    I think the threat of "ban" is out of place for mirage. Even if you ban his user id, he can pursue with his agenda irrespective of whether he is banned or not. IV core should educate mirage and other focus group leaders than threatening to ban them.

    There have been so many divisive threads on this forum. IV admins never thought of banning such members.

    He is a genuine member maybe not knowledgeable as IV core. Thats all.

    Been in the US since 1998, have an EB-2 PD of 2001, have played by the rules all along. Still no GC... And, the dates are going back to 2000 from the new year.. I've lost hopes...

    I'm pretty close to getting clinical depression because of this game played by USCIS, Labor Dept, FBI and my own bad luck.

    SKILL bill, OMNIBUS, etc. comes and goes. IV does seem to be doing things to lobby for the community, but let's face one reality. Like a news article said, no one in congress or senate wants to touch immigration even with a long pole until 2009.

    The US has been very good to me (other than the GC part), more than my home country (India) which is why I'm still here.

    Have invested too much of time in this country to just pack up and go. Just curious if any of you feel this way? How do you handle such depressing feelings?

    Believe me dude when I say that GC is not the real problem of being depressed. There are other so many kinds of problems in life which have no bearing on whether you have a GC or not . I personally have some of them and I wish they were gone . They are my priority and to me GC is just a vague distant dream .. if it comes true well and good or else life goes on.

    Health, family and friends come above anything and if you have all these lined up good and well they beat having a GC :)

    Get busy with anything that you can find .. maybe try making some friends and you will find "its a wonderful life !"

    I am curious to know what's stopping the EB3s to port their dates to the EB2 category. I've been seriously considering this lately.

    I tried doing that. Convinced the employer to file a new labor for a new position, advertized again, filed a new labor under PERM, applied for a new I-140 and waited for a year for approval ... now the I-140 has been denied for A2P and is under appeal; I must confess that I have lost hope that it'll get re-opened and approved.

    So all my efforts for getting a EB2 140 have failed.....what do you recommend, I start this entire process again. Even if I'm willing to bear the cost, the employer will not file yet another labor.

    EB3 wait is my only way out now......

    ,... I haven't visited the forums in a while but doesn't look like much has changed. Division betwen IT and non IT. Dvision between people working at "full time positions". division between eb2 and eb3; country quota, etc.
    ....

    its the same script, just the actors change.

    P.S: Remember you from your days on immigrationportal.com... thanks for spending time on IV. The new-kids-on-the-block are always jumpy and eager, many old-timers who have been beaten into submission by USCIS appreciate your expertise and words of caution...

    We all are equally frustrated with the situation we are in. We can always find reasons to fight within our community (EB Vs FB, Legal Vs Illegal, EB1 vs EB2 Vs EB3 - the list is endless). These outburst of frustrations / arguments and counter arguments do not take us anywhere.

    Let us keep supporting IV and build a strong partnership of interested parties. Let us focus on areas where we can agree. Many among us worked hard to build this community, let us try to strengthen and preserve it.

    Didn't Logfren ask that question to USCIS during last July?
    actually the other question is why doesnt Murthy or IV asks the USCIS (whenever they get a chance to meet) ..to give a breakdown of the 485 pending by category by country. one would hope that atleast someone in uscis has access to such reports .. any idea, thoughts ??

    Today, I received the approval notice in mail. However I did not get the physical cards. The notice says that I may have to do the biometrics again to get the but need not take any action at this time.

    Did you receive the physical cards by now?

    My Case:

    08/12/08 - Approval Notice Sent message (This is the only message I got)
    08/18/08 - Received the Approval notice by post

    No cards till now...:confused:

    For those who got approvals,

    Were there any RFEs regarding birth certificates in the cases where an affidavit was submitted initially?

    I submitted birth affidavit with my application, PD 24/March/06, goes current from 1/Sep.

    I understand from my parents that it takes good effort and may take long time to get the birth certificate. It will be a great help if you can share your experience.

    Does section 201 mean that those with advanced degrees from US Universities are exempt from the 3 year requirement? This clarification is critical because of the 3 years in the RELATED field clause. I do not believe any of the other bills incorporating similar provisions have made this distinction for US advanced degree holders vs advanced degree holders from other countries. I believe all other bills impose the 3 year RELATED field restriction for ALL advanced degree holders.

    If the 3 year RELATED field clause does not exist for US advanced degree holders in STEM, it would give relief to many members.

    Kindly clarify.

    Think Once again,

    Processing application based on Priority dates which is applicable to Any Employement (EB1, EB2, EB3) or Even family categories, with respect to Quota for that catagories..

    Again as Somebody mentioned Earlier, its not going to get solved in 2-3 Months, So this will be helpful only from Futuristic purpose.

    Its Vision problem, But this can't be solved by Lawsuites, It needs discussions, Negotiations and Communication, By Who have access to USCIS representative. In a Nutshell IV or AILA Kind of group, need to bring on their agenda, if they think its in Best interest for everybody.

    Simply put i am used to standing in queue to Buy Coffe, and somebody gets priority I feel i've been bypassed.


    Agree with you completely... and I would like to add one more point is this unnecessary classification of EB-1, EB-2 and EB-3... we are all highly skilled among our respective fields.. and I don't think this classification does any justice... but I very well know this wont be solved in 2-3 days... so no use talking abt it.. i guess

    I was just wondering that how come only desi employers are branded as "blood sucking manicas" etc etc ..? Doesn't there exist same kind of breed from other nationalities ? if not, then question is why we desis are like that ? any idea ?
