    I gave more points to PD month than experience month.
    If you think its more complexes then I will go with PD only.
    New PD means either you are new in US or you dint applied or you got laid off. What ever is the reason of new PD, you or your luck are involved so only you should be responsible. My previous PD was Jul, 2003 with EB2 but INC canceled my company�s LC in group because my company didn�t apply from co-operate office and there was no one in office during INC raid. Later my company applied LC from co-operate office and I got new PD. Even though It would be unfair to talk about experience because some how my or me are involved here.

    So let�s keep only PD as only preference.

    ok then, PD it is, going 1, 2 3..... done!

    From now on, the via numbers will be allocated based on priority dates because 'Few good men' said it on this thread.

    If someone ports from eb3 to eb2 they should get the priority date of the day they were eligible to file an eb2 and not be able to carry the date from eb3.
    Porting makes sense in a family based visa where your petitioner can file for an application while he is still a green card holder and then becomes a citizen which upgrades the beneficiary's category as well.
    On an employment visa you file for an eb3 when you are eligible for an eb3 job, you file for an eb2 when you are eligible for an eb2 job. Why would you be able to jump ahead in the eb2 line when you were clearly did not have an eb2 job ? Just because you filed an application at some point of time in eb3 and waited a decade to get a better job doesn't mean someone else has to pay for your (pick one - laziness, ineptitude, lack of skill or lack of knowledge).
    Most of IV Core is made of eb3 applicants and therefore there has never been any push from the core on this matter. And as someone said .. You ARE eating my lunch..

    Thats YOUR perception, and its totally inaccurate. When xyz had his Eb-3 140 approved, by definition he was OK'd to be immigrant. Now that date belongs to him and if he has gained sufficient expertise/skill level for him to promote to Eb-2 I-140, the transfer of dates is obvious. On the contrary he deserves to be ahead in line because he had already filed Eb-3 way ahead in advance. Calling him an unskilled, inept, or lazy proves him otherwise.

    Nobody is opposing it..it should be based on years of exp in US..I applied mine in 2001 and got laid off and now I have a priority date of jan 2007..is that FAIR?

    So you are laid off so what is the big deal? You should be able to negotiate somehow or escape layoffs by doing something or the other. There are people in my company who survived 6 layoffs. Your layoff is your problem and nothing is fair in the globalization.

    Guys,

    I just got my H1B Extension approved (8th year extension).
    Original H1B was valid until Sept 2008. Changed companies after 180 days(of I485 application) and applied for H1 transfer and extension for 3 years via new company. Finally got it approved after 3 months for 3 years(until May 2011).

    If you have I140 receipt with you, just look at the bottom. It will tell you if it was from NSC or TSC.

    Zoom, I appreciate you having started this thread, I have a suggession - Can you please
    - give a little back ground as to why we are starting this effort

    - Also some one mentioned that Aman was even considering SELLING his house to support OUR cause.
    - what we intend to accomplish by this effort

    - what our target is.

    If you add all this information in the initial post it will give direction and substance to this effort.

    Although the thread title says "Reimburse the core team" and I know that the core team will not take any money (and do not expect the memebrs to reimburse them) from the fund that we are planning on creating here...Stilll by contributing to this fund we can make sure that core does not have to bear any out of pocket personal expense in future while working on "our" goal.
    Lets see how many of us are actually inetested in contributing. Once we have the number we can set a realistic goal and divide amongst ourselves.
    For that I suggest we give this thread good two days to develop and check other members responses...
    So here is a chance for everyone to contribute to our own goal. Lets keep this going. Who ever is interested pls reply. I will do a final count after 2 days as suggested and take it from there....

    Guys everybody has a story, in my area Labors were getting cleared in less than 1 month in mid of 2003.     I see three groups emerging in this disucssion:

    1. We applied labor in 2002/3/4. Therefore, GC should be PD based.
    2. We applied labor in 2001/2/3 but had to reapply in 2005/6, therefore GC should be based on number of years in US.
    3. Govt should "end retrogression" and give green cards to everyone.

    I can understand the rationale of all three groups: they want things to work the way it will benefit them. In some way the rationale of first two groups can be justified also.

    What I am having trouble with third "end retrogression". What does it exactly mean? There are only limited number of GC's per country. Are you talking about merging all the countries into one queue? I am not sure if ROW applicants will like that because that might set them back. Are we talking about raising the per country caps? How do you accomplish this "end retrogression".

    No one's trying to cut the line here. If there's any, it's purely procedural and has nothing to do with 'Ending Retrogression'. With or without retrogression someone might get an RFE, get stuck in namecheck etc. Ending retrogression provides earlier PDs better chances of getting GC faster (if dates are 'C' you get it the month you clear RFE, Name check etc.)

    Just posting here isn't helping you cause. Instead you guys can get together and start sending flowers to USCIS director requesting him to publish the complete list of GC applications approved every year. It's the first step in enforcing FIFO. Right now there is no such list and no way of knowing who got their GC out of turn. And while you guys are at it also send some flowers to FBI to clear Namechecks FIFO, to DOL to approve PERM petitions FIFO etc.

    Go spend those $50 at Flowers.com folks. Start writing to Senators, collect money, do the lobbying etc. Who's stopping you?

    Or do you want logiclife, pappu and rest of the IV core to do it PRO BONO for you?

    I'm guessing ppl who got LUDs recently (mostly on 21st) have been assigned visa numbers which are going to be released only nxt month and they will be approved only in the beginning of Sept.

    Visa numbers for this month have been used up. And going by the # of ppl who got LUDs even if they were not current, my assumption is that their applications were in the same box as the ones who were current and it was a mass update. I think come Sept, they're going to take all applications out of the "LUD Boxes" and sort out only those who are current and start approving them.

    Again, its all assumptions...Nobody knows for sure whats going on...

    What is the commitment period? I know this is frustrating but deal with that as time passes by, who knows you manager changes by the time you decide to change the job or your client send a request to hire you to your vendor and in general no vendor refuse client request. Once this agreement is in file do you think someone will have time to bring this up and read clause by clause that too when you have left... there can be many reasons to leave and can not be covered under any agreement.



    I will not worry about sigining this, this has no value once you get GC or become full time employee,in order to execute this agreement , they have to make sure/prove they have this agreement with each and every employee. Legal terms "EMPLOYMENT IS AT WILL" in order to chase you for 10K they need to spend time & cost both.


    Here you go - These are the wordings !

    I had info pass appointment today in Newark they asked my
    Info pass appointment letter
    I-485 approval letter
    Passports

    I told them it�s almost one a month, I didn�t get my card yet. Then they gave me a token number and when my turn came. I met the USCIS officer he wasn�t much help at all. he just gave me 551 stamp for 1yr and when I asked him about biometric he said last year I took in Oct-07 its good till next month and I don�t need it.

    I was expecting 551 stamp look like h1 visa stamp, but it�s just an ordinary stamp.

    After coming home I called USCIS asked them about the card. She told me that card was sent out for production today and I should get it within 1 week to 30 days. Because it was sent out today that�s the reason I didn�t get the email update

    What else do we need to carry apart from Info pass appointment letter, I-485 approval letter and Passports? I will plan to take an Infopass appointment and get my and my wife's passport stamped.

    DC is the right place even on a weekend also just protesting infront of the uscis office will get media attention .....we should plan for this.i know less than 1000 people will be a failure ..can we try to get the mood of the IV for this kind of event ...

    Indeed we are IT professionals, the billing stops our brain stops ......

    How about giving a proposal to the USCIS to revamp their entire system free of cost so we save future immigrants. Most of us are so called IT professionals arent we.

    Agreed. $5000 is about the same amount a single student paid to TVU, the diploma mill. This used to be the price 1 employee paid a fraud DCC for processing a Green card.
    What more can I say....
    .

    Because people do not understand. Most people take it for granted - especially these kinds of efforts.

    The problem with immigrants is - majority immigrants stick to community and talk to people from their community and do not go beyond that. Most people go to work and come back, they open IV just like facebook etc. only for information or time pass.
