I have been following this thread and you know what, This is THE thread that is going to change the future and lot of things to come.
Personal Information :
I understand some of your concerns of giving personal information, but just think about it, all you are giving is your Email Address and Phone number. You are not giving away Credit card, SSN and Bank Account numbers. Just think about it, Dont you guys already get junk emails and marketing calls. Are you guys not getting mails about Credit Card offers, Macys and Others. So Dont think too much guys. You always have the option of changing the phone number if things get worse. But I dont think that is gonna happen since most of our information are already out there. We will try to work out something with the Admins here to see if we can get a secured page. If not, let one of us take a responsibility of collecting personal information and host a webpage, I know, atleast , one of us can do it.

Guys, Lawyer fees is not an issue, if we get more people in to this. 100 $ ain't too much when you think , you are spending 1000 $ on EAD and AP year after year. Let us shake the USCIS by taking some courageous step. Again, we are not here crossing borders, they invited us here. Every one of us deserve justice and respect. They cant treat us like slaves. They gotto keep up to their promises or else we will demand it.

Companies that are demading for a better Immigarion system and faster green cards. I know, we already have a thread that has a link to the letter that is signed by all big companies in favor of increasing High-Skilled immigrants. Let us make them hear. Let us, all 70 K folks here, send individual letters to every body who,we think, will support us and then to send it to those, who already knows everything about their inefficiencies,but still falling deaf, on our earlier outcry. Let us prove that, we dont just sit out there crying. Let us show them who we really are. Stand for our Self-Respect guys.

Hi guys,
With all the news floating around about the VISAs getting exhausted in early July on one side and having an employer who does not seem too eager to apply for I485 since past two months, how does one deal with it ?
I wish all this was a little less complicated..:confused:

I have mulled over different options in my head for a long time. Here are some things I came up with:
- switch to a part time H1 (and do something else in your free time that you might find a little more fulfilling, i.e enrolling in PT grad program, starting a business (which you CAN do on an H1!!!), travel!!). I know there is the money factor but most of us are IT people and hopefully taking a cut will be worth the improved life.
- begin your Canadian PR process. This takes a lot less time and honestly, I think Canadians are more cultured anyway. Leave these people to their Paris and Nicoles :)

Ok, bear with me here.
Say I have a PD from 1998, but I did not apply for 485 because, say, I wasn't married, or I my religious beliefs did not allow me, or some other reason.
Now when everybody else between 2000 and 2004 have possibly been granted their GCs based on visa availability, how fair it would be for 2005 applicant to be held back just because a 1998 guy applied today? Not it would not be. It is not fair to hold back a 2005 applicant because a 1998 person chose not to apply when the time was ripe.
Now you will argue that 1998 applicant cant be given the PD priority because he did not apply for personal reason, and that is his problem. Sorry, but then you are persecuting that person based on his religious beliefs. a big NO NO.
Bottom line is that PD priority is maintained only through cut-off (priority) dates. Beyond that it is just RD/ND. It may not sound fair to you, but it is actually fair. PD-cut-off already maintain a good priority queue.
Action on these micro-items is not good use of resource. These symptoms are only temporary, and not systemic enough to warrant a legislative action or anything else.

IMHO, you are wrong about the "least resistance" part. Who told you that there is least resistance to change/remove country quota? How did you come to that conclusion?

I can't afford to hire a lawyer - how much they charge ?
Get on with sweet talks with him, do whatever he tells u to do (like sign a contract, pay ur GC cost etc). After filing u have an option to change the employer after 6 months and then no employment bond works. He will just ask for money when ur leaving him and if he doesnt give ur salary, talk to him polietly and mention the words 'Dept of Labor' in your conversation.
BTW, I got my wife salary from her employer and one of my friend was also 'bonded' ..got rid of his employer too ...using those words.
My employer is desi consultant too and is very good in such matters, quite helpful. I would recommend him to anyone. Most desi consultants are blood suckers but not all.

Since you never got an H1-B stamped in your passport, you are not eligible for AVR (since there is no H1B visa to revalidate). You could do AVR for F-1 since you have that stamp but that is also NOT VIABLE any more because you are now not eligible/admissible for F-1.
I think, F-1 Visa to H1B AVR is allowed, when F-1 is adjusted to H1B in USA.

Thank you, texcan. FP may not be requierd for EAD renewal or first-time EAD? Mine is first time EAD. So, eseentially no FP yet for 485 (filed August 07) and first time EAD (this August)!

It is really sad to hear that. I am no expert by any means but assuming that you are still a young family (say in mid thirties), I would suggest that unless your family is financially secure and have other family members here in the USA to lean on, I will suggest to at least consider the option of going back, irrespective of what the outcome of you green card process may be.
